Reviewing a Total-Loss Car Offer After a Corpus Christi Accident

A total-loss offer can leave you with two different questions: how did the insurer value your car, and how much will actually be paid? After a Corpus Christi crash, organize those questions before responding. A written valuation and a short list of specific discrepancies are more useful than a general statement that the offer seems low.

Understand what the offer measures

The Texas Department of Insurance (TDI) explains that actual cash value accounts for depreciation from age and wear. A totaled used car is generally valued as a used car, rather than the price of a new replacement. The payment also may be less than the balance on your loan. Check your purchase and policy documents for any gap or loan/lease coverage instead of assuming the settlement will pay off the lender.

Ask for the valuation and check the inputs

Request the written offer, the valuation report used to calculate it, and an itemized explanation of the proposed payment. Keep the documents together with your claim number and the adjuster’s contact information. As a practical review checklist, compare the report with your own records:

• Vehicle identity: Are the VIN, model year, make, model and trim correct?

• Vehicle details: Do the recorded mileage, equipment and options match your vehicle? Note each mismatch and attach the record or photograph that supports your correction.

• Condition: Ask what supports any condition adjustment you do not understand. Supply relevant pre-crash photographs or records rather than guessing about the reason.

• Payment breakdown: Ask the adjuster to explain each addition or deduction, whether a deductible applies, and any payment directed to a lender.

Gather comparable vehicles from the local market

TDI recommends obtaining written used-car dealer quotes and checking nearby listings for similar vehicles. It also suggests documenting special features and presenting that information when asking the insurer to reconsider.

For a Corpus Christi vehicle, begin with Corpus Christi and nearby Coastal Bend listings. Save the listing date, seller, location, asking price, mileage and trim. Put meaningful differences beside each listing so the adjuster can see why you included it. A different model or a much lower-mileage vehicle needs explanation; a screenshot of its price alone is not a complete comparison.

Make a focused written request

Consider a short message such as: “Please review the attached valuation corrections and comparable vehicles. The report lists [detail], while my attached record shows [detail]. Please explain whether this changes the valuation and send an updated payment breakdown.” Fill in only information you can support, and save the response with the original offer.

If the amount remains disputed

For a dispute with your own insurer, ask whether your policy’s appraisal process applies. TDI describes a process involving an appraiser for each side and an umpire, with costs to the policyholder. Review the policy and costs before proceeding; do not assume your own policy’s appraisal procedure applies to a claim against another driver’s insurer.

If you want to retain the totaled car, ask how that changes the offer. TDI says the insurer deducts salvage value when the owner keeps it. Also confirm your rental return date separately rather than assuming transportation remains approved while the valuation is discussed.
